The Water (Prevention and Control of Pollution) Act, 1974, and the Air (Prevention and Control of Pollution) Act, 1981, require industries to obtain permission from State Pollution Control Boards (SPCBs) before establishing or operating. These permissions — Consent to Establish (CTE) and Consent to Operate (CTO) — are fundamental to legal industrial operation in India.

📌 Key rule: Operating without a valid CTE or CTO is a criminal offence under both the Water and Air Acts, with penalties including imprisonment of up to 6 years and/or fines.

What Is Consent to Establish (CTE)?

CTE — also called "No Objection Certificate" by some SPCBs — is the prior permission required before setting up a new industrial unit or making significant expansion to an existing one. It is obtained before construction begins and is valid for a fixed period (typically 3–5 years) to complete the project.

CTE essentially confirms that your proposed process and pollution control infrastructure design meets SPCB standards. It is not a licence to discharge effluents — that comes with CTO.

What Is Consent to Operate (CTO)?

CTO is obtained after the plant is constructed and before it begins commercial operations. During the CTO application, the SPCB physically verifies that the constructed pollution control equipment matches the approved CTE design. CTO is typically valid for 1–5 years depending on the industry category and must be renewed before expiry.

Documents Required for CTE Application

Common Reasons for CTE/CTO Rejection

💡 BEC Tip: The most common delay is inadequate ETP design documentation. Engage a qualified environmental engineer to prepare a detailed ETP design report with hydraulic calculations, chemical dosing details, and treated water quality projections before filing your CTE application.

Conclusion

Navigating the CTE/CTO process requires meticulous documentation, understanding of SPCB-specific requirements (which vary by state), and proactive follow-up. Early engagement with an environmental consultant experienced in SPCB liaison can significantly reduce approval timelines and rejection risk.
